Prospects for AI Regulation

Congressional committees heard from AI experts, including Sam Altman, the CEO of Open AI, last week on how policymakers should respond to recent advances in AI technology. In addition, the Administration is demonstrating significant effort in developing potential regulations for a variety of AI technologies.
- A Senate hearing with Altman focused on the type of regulatory framework that should be applicable to AI development and deployment that would most protect consumers without crimping innovation—while also discussing serious concerns with the use of the technology.
- A House hearing focused on how existing copyright laws should apply for AI systems trained on protected content, whether traditional “fair use” doctrine sufficiently protects copyright holders, and whether AI-generated outputs would be subject to” copyright.
- The hearings primarily laid out the bounds and decision points of how AI regulatory frameworks might be developed as policymakers continue considering paths for possible regulation.
- The Administration is also building on its previous AI Bill of Rights and Risk Management Framework to develop more comprehensive plans, in particular for Federal use of AI systems.
