Pandemic Regulatory Changes: Should They Stay or Should They Go?

CED has promoted the policy of “smart regulation” – regulations that are well-designed at the outset to achieve the purpose for which it was imposed at the lowest possible cost and with the maximum possible benefits. Smart regulations are ones that are continually reviewed, revised, or sunset, particularly given the rapid pace of technological change.

Today, the nation has a unique opportunity to do just that. The COVID-19 crisis required the waiver of many regulatory policies across the economy, but perhaps most urgently and most importantly in healthcare, one of the most heavily regulated sectors. It also brought into effect new regulations in an attempt to meet the demands of the crisis.

This webcast will consider three examples of regulation during the pandemic from CED’s perspective of smart regulation, including two cases of regulatory flexibility and one of regulatory overreach, and, will assess the lessons learned for business and public policy leaders about the best approaches to regulation in the nation’s interest.

By attending this webcast you’ll learn:

  • How the overall approach to regulation needs to be reformed so it can achieve its objectives smartly
  • How the waivers of regulation during the pandemic positively impacted the course of the pandemic, particularly in its most acute phase
  • Whether and how telehealth can be expanded even after the pandemic is over
  • How FDA regulatory flexibility helped speed approval of vaccines and therapeutics for COVID-19
  • Why the Supreme Court overturned the vaccination mandate and the lessons of regulatory overreach
