The Future of Regulatory Law

A series of recent cases from the Supreme Court has dramatically changed the contours of administrative (regulatory) law that governs how agencies issue regulations and how administrative law judges adjudicate matters before them. Broadly, these cases have sharply restricted the scope of agencies’ powers as well as the powers of independent regulatory agencies such as the Securities and Exchange Commission (SEC).

These Supreme Court decisions, including SEC v. Jarkesy and Loper Bright Enterprises v. Raimondo, impact every business regulated by a federal agency. They pose significant questions for the future of administrative law and will lead to future litigation. A distinguished panel of experts will discuss these cases and the implications for regulated businesses in all types of industries.

By attending, you will learn:

  • What the Supreme Court decided and the concerns of dissenting Justices
  • How agencies are responding to these cases
  • How the business community is beginning to respond to these cases
  • How these cases are likely to change future regulation
  • How the role of administrative law judges may change
