Given the extraordinary response by the corporate community, the ESG Center partnered with the law firm Hughes Hubbard & Reed to brief members on sanctions and seizures as a result of the Russian invastion of Ukraine.

The United States, EU, and other countries have imposed “sweeping financial sanctions and stringent export controls” on Russia for their invasion on Ukraine and many companies have followed suite in cutting ties with Russia. Russian prosecutors have responded with threats of lawsuits and asset seizures.

The ESG Center was joined by global experts, Partners at Hughes Hubbard, Jim Boykin and Ryan Fayhee. Hughes Hubbard is famed on their arbitration victories against the Russian Federation on behalf of Ukrainian businesses in the aftermath of the Crimean annexation.

Jim and Ryan briefed members on their experiences with sanctions and seizures and provide guidance on potential seizures. They discussed:

Dealing with Sanctions

  • What has happened?
  • What does it mean for companies that are directly or indirectly affected?
  • What are the key compliance and contractual issues to consider?
  • How should sanctions factor into the broader discussion of your company’s response?

Background on Seizures

  • What happens when your assets are seized?
  • What is the legal framework for seeking redress?
  • How do you collect?  What are the realities of enforcement under Bilateral Investment Treaties?
  • What should you do to prepare for potential seizures?
